You have several options on the format of the data to be uploaded.  Employers may upload:

When do we need your data?

Once your enrollments are completed for a given year, please upload your data.  This is typically early December for the given tax year, but could be later upon finalization of your enrollments.

Overview

  • “PLUS” Service is for Clients that are well versed in ACA Reporting for ALEs.
  • Clients should understand in detail lines 14 to 16 coding, Part III instructions for covered individuals, and how to complete all fields in all forms 1094C and 1095C.
  • Those not familiar with the ACA Reporting Requirements or unable to complete the template should consider upgrading to the ACAPrime White Glove Service.

Penalties for Non-Compliance

For returns due in 2025 (2024 tax season), in addition to the standard “A” and “B” penalties, companies face up to $990 ($330×3) per form from these penalties:

  • Failure to file a Correct return with the IRS is $330 per form
  • Failure to provide a Correct payee statement is $330 per form
  • Failure to file electronically with IRS, if required, may be subject to a penalty of $330 per form

Example Penalty Calculation:  If an employer has 200 1095 forms to file and does so incorrectly, they could face a penalty of as much as $198,000.

ALE Determination: Which Forms to Report?

ACAPrime can help you determine an employer’s filing status for any given year free of charge.   Employers will need to supply requisite hours and employee data for the previous year.

  • Small Group “B” Forms

Groups that are not ALEs (applicable large employers) offering self-insured group health plans, level-funded group health plans, or ICHRAs must file type “B” Forms.  Here are the IRS instructions for filing 1094-B and 1095-B forms:  https://www.irs.gov/pub/irs-pdf/i109495b.pdf.

  • Large Group “C” Forms

Any employer that averages over 50 FTES (full time equivalents) for the previous calendar year is considered an ALE (Applicable Large Employer) for the current calendar year.  Here are the IRS instructions for filing 1094-C and 1095-C forms:  https://www.irs.gov/pub/irs-pdf/i109495c.pdf.

  • ACA Reporting Not Applicable

Employer with less than 50 FTE in the prior calendar year and either do not offer group health plan or offer a fully-insured plan, you are not subject to ACA reporting.

Key Due Dates and Timeline

Note:  ACAPrime does not have a cutoff date.  That said, we just cannot guarantee delivery of services by a given IRS deadline if requisite data is not made available at least 21 days prior to a given deadline.

  • Q3 & Q4 of 2024: Collect Employer Level Info and Implementation Form Answer to Questions
  • Late Dec 2024 / Early Jan 2025:   Collect all data needed for processing including Census and Enrollment Information.
  • Late Jan 2025 / Early Feb 2025:   Finalize Filing for Review and Sign Off by Group.
  • Mar 3, 2025:     IRS Employee Form Distribution Deadline 
  • Mar 24, 2025:   E-File all Groups – we wait until then so we have any last corrections to names, addresses, etc
  • Mar 30, 2025:   Notify all groups E-file is successful, ask for any SSN/Name corrections as specified by IRS acknowledgment
  • Mar 31, 2025:   IRS E-File Deadline
  • Through-out Year:  We handle back filings for those employers that have not filed and handle IRS letter responses (typically new clients that did not file or have a penalty).

IRS Inquiry Help: For customers that signed up for our Premium Service: If your company ever receives any type of question around what was reported in your ACA filing, be it a 226-J letter, 5699 letter, or otherwise, ACAPrime will help you review, analyze, and create a detailed response Note: We have helped many companies (that did not originally use our services) to respond to IRS inquiries and help mitigate penalties.

Penalty Reimbursement for Errors: If it is found that ACAPrime made an error in reporting or filing that caused a penalty, we will cover the cost of that penalty. (Note: This has not happened. But we are asked by new clients quite a bit for this assurance.) ACAPrime carries E&O Insurance just in case.

State Level Reporting Included Now and Forever: U.S. states continue to pass laws requiring ACA related reporting for employers and employees. ACAPrime includes handling all state requirements as part of our service free of charge now and in the future. Our goal is to make this easy for all of our clients. Information Retention and Data Security: We retain all data used to compile ACA reporting including all communications for a period of at least 7 years.

Electronic Filing Requirements

As of the 2023 tax season, practically all but the smallest employers must electronically file their required 1094 and 1095 forms.  The new “aggregation of returns” rule requires employers to sum up their employer form submissions each year, including forms W-2, 1099, as we all as the 1094B/C and 1095B/C.  If this sum is 10 or greater, they must file each form as required electronically.

Submitting ACA forms (1094B/C and 1095B/C) electronically requires an employer to meet specific formatting guidelines and also apply for a TCC.    For more information, see:  https://www.irs.gov/e-file-providers/air/apply-for-the-affordable-care-act-for-transmitter-control-code-tcc.  The vast majority of employers outsource the electronic filing to a third-party firm that specializes in these filings.
